Article 1: General provisions
The e-commerce website of Shapr, Part of Helix Outdoor B.V. a company with registered office at Donderheide 3C, 2500 Koningshooikt, BTW BE 0744.917.933, (hereinafter referred to as ‘Shapr’) offers its customers the opportunity to purchase the products from its web shop online. These General Terms and Conditions (“Terms”) apply to any order placed by a visitor to this e-commerce website (“Customer”). When placing an order through Shapr’s web store, the Customer must expressly accept these Conditions, thereby agreeing to the applicability of these Conditions, to the exclusion of all other conditions. Additional terms and conditions of the Customer are excluded, unless they have been expressly accepted by Shapr in advance, in writing.
Article 2: Price
All prices stated are expressed in EURO, always including VAT and all other duties or taxes required by the Customer. If delivery, reservation or administrative costs are charged, this will be stated separately. The delivery costs for Belgium, the Netherlands, Germany, France and Luxembourg are €6.99. The other European countries have a delivery cost of €15. The price statement refers exclusively to the articles as described verbatim. The accompanying photos are intended for decorative purposes and may contain elements that are not included in the price.
Article 3: Offer
Despite the fact that the online catalog and the e-commerce website have been compiled with the greatest possible care, it is still possible that the information provided is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Shapr. Shapr is only bound to an obligation of means with regard to the correctness and completeness of the information provided. Article 4: Online purchases
Adding products to the shopping cart can be done in various ways. This can be done from the product itself, which are visible on various pages, as well as on the product page itself. After adding one or more products, you can consult the shopping cart to view/edit a list of the products to be ordered. This can be done by clicking on the basket in the top right corner. From the shopping cart you can continue to the checkout process by pressing checkout. Here you have to fill in personal details and check whether everything is entered correctly. Article 5: Delivery and execution of the agreement

Article 7: Right of withdrawal
The provisions of this article only apply to Customers who purchase items online from Shapr in their capacity as consumers. Article 8: Warranty
Under the law of September 21, 2004 on the protection of consumers in the sale of consumer goods, the consumer has legal rights. This legal guarantee is valid from the date of delivery to the first owner. Any commercial warranty does not affect these rights. To invoke the warranty, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods. For items purchased online and delivered to the Customer’s home, Customer must contact Shapr customer service and return the item to Shapr at its expense. In the event of a defect, the Customer must inform Shapr as soon as possible. In any case, any defect must be reported by the Customer within a period of 2 months after its discovery. Afterwards, any right to repair or replacement lapses. The (commercial and/or legal) warranty never applies to defects that arise as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, non-compliance with the instructions for use or manual, adjustments or changes to the item, heavy-handed use, poor maintenance, or any other abnormal or incorrect use. Defects that manifest themselves after a period of 6 months following the date of purchase, if applicable delivery, are deemed not to be hidden defects, unless proven otherwise by the Customer.

Article 10: Sanctions for non-payment
Without prejudice to the exercise of other rights that Shapr has at its disposal, in the event of non-payment or late payment from the date of default, by operation of law and without notice, the Customer owes an interest of 10% per year on the unpaid amount. These Terms are supplemented by other terms and conditions explicitly referred to, and Shapr’s general terms and conditions of sale. In the event of a conflict, these Terms and Conditions shall prevail.
Article 15: Evidence
The Customer accepts that electronic communications and backups can serve as evidence.
Article 16: Applicable law – Disputes
Belgian law applies, with the exception of the provisions of private international law regarding applicable law. The courts of the Consumer’s place of residence are competent in legal disputes. The Consumer can also contact the ODR platform (http://ec.europa.eu/consumers/odr/).

Shipping & returns
As soon as an order comes in, it will be processed. Each product, on the other hand, can contain a different delivery time. This will be communicated with the product in question, with the product status to be more precise.
We try to keep delivery times as short as possible. Ordered before 4 pm will be delivered the next day. However, this does not always go well, and we mention that it can take 1-3 days for your shipment to arrive.
We ship via Bpost, and will later try to expand our shipping methods with more options.

We only ship within Europe
Customers may return most Products for a full refund within fourteen (14) days of the purchase date, in the original, complete retail packaging and with a copy of proof of purchase.
Customized items cannot be returnd.
Shapr reserves the right to refuse returns with wear, abuse or damage. The refund will try to use the same payment method as the original payment. If this is not possible, a bank transfer will take place.
Return of my order
You have the right to withdraw from the contract within 14 days without giving reasons. The withdrawal period expires 14 days after you, or a third party designated by you – with the exception of the courier, have physically taken possession of the product.

We believe in the principle of discovering and buying. Instead of extensively ordering and returning products online. We therefore ask you to return the product to our physical store at Donderheide 3.
If you are not able to visit our store, the cost of shipping with your return is at your own expense, unless you send a return because you received a wrong or damaged item. Returns are at your own risk. This means that Shapr is not liable for damaged or lost items that have been returned. Make sure that you always send the return shipment in such a way that it is traceable and keep the Track & Trace code carefully.
